Company: Raktaspriha
Portal: onboard.raktaspriha.site
Notice of Proposed Content for Legal Review: The terms and policies set forth below represent the operational standard and proposed legal terms for candidate applications and employee onboarding at Raktaspriha. These clauses are subject to formal confirmation by qualified Indian legal counsel prior to binding contractual execution.

A. Accuracy of Information

Applicants and onboarding candidates represent and warrant that all information, qualifications, employment history, residential records, and submitted documentation provided through this portal are true, accurate, complete, and up-to-date to the best of their knowledge.

Candidates must not knowingly submit forged, manipulated, misleading, or unauthorized documents or statements. Any material misrepresentation, omission, or fraudulent submission discovered at any stage of the application, interview, onboarding, or subsequent employment may result in immediate disqualification, withdrawal of any offer, disciplinary measures, termination of employment where permitted by applicable law, and appropriate legal reporting.

B. Confidentiality and Non-Disclosure

All employees, selected candidates, and authorized contractors must strictly safeguard and maintain the confidentiality of Raktaspriha’s non-public confidential information. Confidential information includes, without limitation:

  • Technical Information: Proprietary source code, software repositories, architectural blueprints, database models, technical specifications, and internal algorithms.
  • Security Credentials: API keys, cryptographic tokens, passwords, database credentials, server certificates, and access configurations.
  • Business Records: Client lists, partner records, financial data, pricing arrangements, marketing strategies, and internal correspondence.
  • Intellectual Inventions: Unpublished designs, prototypes, software implementations, and proprietary methodologies.
  • Trade Secrets: Any information expressly designated as confidential or which a reasonable person in the circumstances would understand to be confidential.

Employees shall not disclose, publish, reproduce, distribute, sell, or make available any confidential information to unauthorized third parties, and shall utilize such information exclusively for authorized company business in strict compliance with information security guidelines.

C. Exceptions to Confidentiality

Confidentiality obligations do not prohibit or restrict disclosures where:

  • The information has entered the public domain without any breach of confidentiality or wrongful act.
  • The information was lawfully obtained from an independent third party without restriction on disclosure.
  • Disclosure is mandatory pursuant to applicable statutory law, regulation, or a lawful order issued by a court or competent governmental authority.
  • Protected disclosures, lawful reporting of corporate wrongdoing, or cooperation with investigative authorities under whistleblower or statutory protection laws.

Where legally permissible, the individual shall provide reasonable advance written notice to Raktaspriha before any legally compelled disclosure to allow the company to seek an appropriate protective order. Confidentiality obligations shall endure for the maximum duration permitted by applicable law, and trade secrets shall remain protected for as long as they qualify as trade secrets.

D. Account and Security Responsibilities

Personnel granted access to Raktaspriha systems, portals, and infrastructure must observe standard security hygiene:

  • Maintain the absolute secrecy of assigned corporate credentials, multi-factor tokens, and access keys.
  • Access company systems solely via approved, secure network protocols and authenticated devices.
  • Avoid unauthorized access, privilege escalation, or sharing of individual accounts.
  • Promptly notify the security and administrative team upon discovering any credential leakage, lost device, or suspected data breach.
  • Return or securely destroy company data upon termination or request, subject to lawful retention requirements.

E. Intellectual Property

Work product created, authored, developed, or conceived by an employee or contractor within the scope of their employment or contractual duties with Raktaspriha shall be governed by applicable project agreements and governing intellectual property laws.

This includes source code, technical documentation, architectural designs, algorithms, and associated deliverables, while strictly respecting pre-existing personal intellectual property, legitimate third-party open-source software licences, and statutory rights that cannot legally be transferred. Raktaspriha does not assert ownership over personal projects or creative works developed outside working hours and without the use of company resources, equipment, or confidential data.

F. Company Equipment and Property

All hardware, digital accounts, documentation, equipment, and access badges provided to employees remain the exclusive property of Raktaspriha. Equipment must be handled responsibly and returned immediately upon conclusion of employment or upon notice. Employees must not retain copies of confidential software or company records following termination of engagement.

Furthermore, only authorized corporate spokespersons may represent, make statements on behalf of, or legally bind Raktaspriha.

H. Misconduct and Legal Remedies

Violations of these terms or documented policies may result in proportionate internal disciplinary action, termination of employment where lawful, revocation of system credentials, and pursuit of civil or injunctive remedies under applicable law. Nothing in these terms guarantees a specific legal outcome or deprives any party of statutory rights or lawful defences.

I. Ending Employment

Upon termination, cessation, or conclusion of an engagement, the individual shall surrender all company assets, delete non-public company information from personal storage environments, and honor ongoing confidentiality obligations.

J. Applicable Law and Dispute Resolution

These terms are formulated under the applicable laws of India. Any dispute arising out of or in connection with recruitment, application data, or onboarding formalities shall be subject to the jurisdiction and dispute resolution mechanisms determined after formal legal review.

K. Electronic Records and Signatures

The portal records electronic acceptance of these terms along with IP metadata, user agent, and timestamp to maintain a reliable audit trail.

Notice Regarding Handwritten Signature Image Upload: Uploading an image or scan of a handwritten physical paper signature provides visual verification of identity and intent for recruitment and internal file compilation. However, it does not automatically constitute a statutory digital signature under the Information Technology Act, 2000. Separate formal electronic signature integrations (such as eSign) or wet-ink agreements may be executed when mandated by final employment contracts.
